Privacy Policy for BaseHead, LLC

At BaseHead, LLC, accessible from www.baseheadinc.com, one of our main priorities is the privacy of our visitors. This document covers what information is collected and recorded by BaseHead, LLC, and how we use it.

This policy applies only to our online activities and is valid for visitors to our website with regards to the information they share with or that is collected by BaseHead, LLC. It is not applicable to information collected offline or via other channels.

Information we collect

The personal information that you are asked to provide, and the reasons why, will be made clear at the point we ask you to provide it.

If you contact us directly, we may receive additional information such as your name, email address, phone number, the contents of the message and any attachments, and any other information you choose to provide.

When you register for an account, we may ask for your contact information, including name, company name, address, email address, and telephone number.

How we use your information

We use the information we collect in various ways, including to:

  • Provide, operate, and maintain our website
  • Improve, personalize, and expand our website
  • Understand and analyze how you use our website
  • Develop new products, services, features, and functionality
  • Communicate with you directly via email for customer service or to provide updates relating to products you’ve purchased

Log files

BaseHead, LLC follows a standard procedure of using log files. These files log visitors when they visit websites — all hosting companies do this as part of their analytics services. The information collected includes IP addresses, browser type, ISP, date and time stamps, referring/exit pages, and possibly the number of clicks. None of this is linked to personally identifiable information. The purpose is analyzing trends, administering the site, tracking users’ movement on the website, and gathering demographic information.

Cookies and web beacons

Like most websites, BaseHead, LLC uses cookies. These are used to store information including visitor preferences and the pages on the website that the visitor accessed. The information is used to optimize the user experience by customizing page content based on browser type and other information.

Advertising partners

The BaseHead, LLC website does not currently have any 3rd-party advertising on it, nor do we plan to add any. To the best of our knowledge, no third-party ad servers or networks use cookies, JavaScript, or web beacons on our site.

Third-party privacy policies

BaseHead, LLC’s Privacy Policy does not apply to other advertisers or websites. We advise you to consult the respective Privacy Policies of these third-party servers for more detailed information, including their practices and instructions for opting out.

CCPA privacy rights (Do Not Sell My Personal Information)

Under the CCPA, California consumers have the right to:

  • Request that a business that collects a consumer’s personal data disclose the categories and specific pieces of personal data collected.
  • Request that a business delete any personal data about the consumer it has collected.
  • Request that a business that sells a consumer’s personal data not sell that data.

GDPR data protection rights

We want to make sure you are fully aware of your data protection rights. Every user is entitled to:

  • Right to access — request copies of your personal data. We may charge a small fee for this service.
  • Right to rectification — ask us to correct information you believe is inaccurate, or complete information you believe is incomplete.
  • Right to erasure — request that we erase your personal data, under certain conditions.
  • Right to restrict processing — ask us to restrict the processing of your personal data, under certain conditions.
  • Right to object to processing — object to our processing of your personal data, under certain conditions.
  • Right to data portability — request that we transfer your data to another organization or directly to you, under certain conditions.

Children’s information

Another part of our priority is adding protection for children using the internet. We encourage parents and guardians to observe, participate in, and/or monitor and guide their online activity.

BaseHead, LLC does not knowingly collect any personally identifiable information from children under the age of 13. If you think your child provided this kind of information on our website, please contact us immediately and we’ll do our best to promptly remove it from our records.

BaseHead, LLC End User Licensing Agreement

It is important that you read and fully understand the following.

This BaseHead, LLC End-User License Agreement (“EULA”) is a legal agreement between you (either an individual or a single entity) and BaseHead, LLC for the BaseHead, LLC software product(s) accompanying this EULA, which include computer software and may include online or electronic documentation, associated media, and printed materials (“SOFTWARE PRODUCT”). By installing, copying, or initiating use of the SOFTWARE PRODUCT or UPDATES (as defined below), you agree to be bound by the terms of this EULA. If you do not agree, do not install, copy, or use the SOFTWARE PRODUCT.

SOFTWARE PRODUCTS are defined as basehead.

General license grant

As a single individual or entity, BaseHead, LLC grants you a nonexclusive license to use copies of the SOFTWARE PRODUCT in the manner outlined below.

Important: The basehead Free Edition may not be used at EDUs or any commercial facilities unless by an individual who is self-employed, or for evaluation purposes only. Facilities cannot outfit a commercial space with basehead Free — if you have money to pay rent for a building, you have money to purchase at least the Lite Edition and support us.

Copyright

All title and copyrights in and to the SOFTWARE PRODUCT (including but not limited to any images, photographs, animations, video, audio, music, text, and applets incorporated into the SOFTWARE PRODUCT), the accompanying printed materials, and any copies of the SOFTWARE PRODUCT are owned by BaseHead, LLC or its suppliers. The SOFTWARE PRODUCT is protected by copyright laws and international treaty provisions.

Terms of service for the CloudPack Manager

All sales are final for sound effects packs sold via the CloudPack Manager, as they are digital goods. The end user is responsible for reviewing and following the EULA for each individual manufacturer of these packs and shall contact the vendor directly for support.

Update license terms

All UPDATES shall be considered part of the SOFTWARE PRODUCT and are subject to the terms and conditions of this EULA. Additional license terms may accompany UPDATES. Installation, copying, or use of UPDATES will be deemed agreement to be bound by any terms accompanying each said UPDATE. If you do not agree to additional license terms, do not install, copy, or otherwise use them.

Other rights and limitations

  • Not for resale. You may not resell or otherwise transfer for value the SOFTWARE PRODUCT.
  • Reverse engineering. You may not reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT, except where such activity is expressly permitted by applicable law.
  • Rental. You may not rent, lease, or lend the SOFTWARE PRODUCT.

Disclaimer of warranty

NO WARRANTIES. THE SOFTWARE PRODUCT IS PROVIDED IN ITS ENTIRETY AND IS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT AUTHORIZED BY APPLICABLE LAW, BASEHEAD, LLC AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND ANY WARRANTY AGAINST INFRINGEMENT, WITH REGARD TO THE SOFTWARE PRODUCT. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY HAVE OTHERS, WHICH VARY FROM STATE/JURISDICTION TO STATE/JURISDICTION.

Customer remedies

YOUR EXCLUSIVE REMEDY AND BASEHEAD’S ENTIRE LIABILITY DOES NOT EXCEED THE PRICE PAID FOR THE SOFTWARE PRODUCT.

Limitation of liability

TO THE MAXIMUM EXTENT AUTHORIZED BY APPLICABLE LAW, NO CIRCUMSTANCE WILL PLACE BASEHEAD, LLC OR ITS SUPPLIERS AS LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE PRODUCT OR THE FAILURE TO PROVIDE SUPPORT SERVICES, EVEN IF BASEHEAD, LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. REGARDLESS, BASEHEAD’S ENTIRE LIABILITY UNDER ANY PROVISION OF THIS EULA SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU FOR THE SOFTWARE PRODUCT.

For all those who skip to the bottom without reading the important stuff:

I agree to be cool and groovy when it comes to basehead. If stuff is deleted, corrupted, or crashes, I shall make no claims against basehead or its makers. Instead, I’ll submit bug reports when possible so they can be resolved quickly.

It’s the end user’s responsibility to back up any content used inside basehead. I also agree not to sue or take legal action against basehead or its makers — they’re just trying to make my life simpler, and sometimes accidents happen.
